Probate is essentially.
The only time probate is not needed is if someone else's name is XXXXX XXXXX as a joint tenant.
Perhaps that happened with your friend?
This is very basic estate law. There is no doubt about this. If there is only the name of the deceased on the title then probate is absolutely mandatory.

Province of Ontario: I am the oldest child and the only daughter of my mother who is presently 87 yrs old. Years ago she made a Will with me as sole Executor. I have three younger brothers. My mom has recently informed me that 3 years ago she went to the lawyer';s office and added my oldest brother's name on the Will as an Executor with me. That wouldn't be a concern for me except that, he has and still has Revenue Canada watching him for suspected undeclared income in a very large amount.
