Yes, if the contractor has not performed the work properly and made errors, and overcharged you, you could sue him for breach of contract and possibly negligence too. Breach of contract in that you hired/contracted him to perform tasks properly and to certain specifications, which he failed to do in accordance with the agreement. Negligence because he owed you a duty to perform the tasks with care, and he failed to do so, which caused you economic damage (i.e. costs in having to fix his mistakes). So, you could sue for the damage he caused you, which may include the amount for which he overcharged you. If Home Deport pays you this amount then that would likely preclude you from suing the contractor. If Home Depot is refusing to pay you the amount you are entitled to, then you can sue the contractor; you could also try suing Home Depot, even though generally contractors are independent and have their own liability, rather than Home Depot being vicariously liable as the contractor acted on their behalf.
