I think she wants to control the stuation. Mom was difficult and my sister refused to help her over 10 years ago. I looked after her shopping and Doctor visits and any get togethers on special days were with my family

My sister visited her 2 times a year until 2 years ago when Mom had 2 strokes. As joint poa's she had to come once a month to sign cheques for Mom's care and make decisions . She demanded gas money and highway fees for every trip. I kept records of all my trips and got mileage reimbursement also even though I had never done that before. Mom got terminal cancer and died in the senior residence in january of this year.

I don't understand why she is doing this either. She has been seeing a lawyer for the last 2 years (after she found out Mom had about $500,000) and wanted to discuss the estate long before she was dead.

I did a personal loan with my Mom in 2010 , that she was aware of,

lawyer notarized, protected with my life insurance ,monthly payments made and balance owing included on the probate and to be paid back from my share of the inheritance. I am a retired bank manager(35 years) so Mom always looked to me for financial advice and I gave her double the interest she would have got on GIC and it lowered my mortgage with less interest. I think she was jealous even though Mom always treated her better and it bothers her that I am more educated and experienced in financial matters (she has all the artistic talents) she has been fired from many jobs and always seems to have legal counsel afterwards and legal issues with her neighbours. She doesn't understand income taxes and has given Mom's CA a difficult time and even called the CRA on her for an error the lawyer made in sending a T5 lawyers trust account to put on Mom's taxes that wasn't hers. A T1 adjustment has been made but she insinuated that it must have been money I was hiding from her even though the lawyer ( she insisted on having) told her it was another clients T5 and his office's mistake

My concern is that she will still not co-operate as she is quite wealthy,owning several houses numerous properties and two farms and has no debt. I am retired and have a mortgage on my own home as well as a mortgage on a home I purchased for my son and his wife and baby that they pay rent to cover the mortgage and property taxes. When her father-in-law died her husband fought both in the hospital and at the funeral with his brother because the brother was given the larger family farm and her husband was given a smaller one. I'm sure her husband is a big part of the problem. She knows I could really use this money to help my son and to make my last years more comfortable and wouldn't want it to be spent on lawyers and court. After the awful last 2 months of Mom's life ( she only came 4 times) I am emotionally spent and very stressed about all of this . She has lost me as a sister. I just want this over.

How difficult is it to get a court order for this and will it be very costly for me. Is she required to continue with the completion of the estate and how long is she allowed to stall.

Is there a time limit for her to comply as the lawyer already has the funds in trust and there will be no interest on the money for the beneficiaries from now on.
