Hi,
I'm going to try and be as frank as possible which means I know I did something I shouldn't have but I still want to know if the repercussions are justified.

On the weekend I was out with some friends at a club, drinking and dancing, like everyone else. I was with a couple of friends who went out for a smoke. I don't smoke myself and my friend said to stay there and that they'd be back. I decided to go out and try a smoke myself. No one gave me a stamp on the way out and I didn't know you needed one. So, when I tried to get back in, they wouldn't let me because I didn't have a stamp. Ok, fine, I paid another $10 to get another ticket and get back in. The person that you give the ticket to decided that I look too drunk (which I wasn't imo and there were people way more drunk than me) and got the bouncer to come and kick me out. My friends were in the club so this was pretty disappointing and, on top of that, they didn't give me my $10 back.

At that point, I just put my tail between my legs and went across the street to another bar, hoping to meet them when they come out. I ended up leaving that bar around 1am and went back across the street and confronted the bouncer that kicked me out that I was already in the club and wasn't too drunk. He was up on the step and there were a lot of people around and I was down on the sidewalk. Obviously, he didn't like what I was saying because he came down and pushed me and said, "get out of my face!" even though I wasn't near his face (I think I would have been about 3-4 feet away). I pushed him back while he was on the sidewalk pushing me so it happened pretty fast. I don't think he had a right to push me because he didn't like what I was saying and maybe he realized that he made a mistake by not letting me back in and charging me twice and not giving me my money back. Either way, he acted pretty immaturely and reactively and the fact that he's a bouncer probably gives him more of a sense of power and less accountability.

The next thing that happened was that 2 or 3 bouncers jumped me and took me to the ground and one put a choke hold around my neck while the other sat on my legs which scraped up my legs and scratched up my new $60 shorts. My tongue was stuck between my teeth which now hurts like hell to eat or drink because he was choking me.

I didn't make the first move, I didn't try to attack the bouncer, or punch him, kick him or do anything that was threatening or warranted being held on the ground in front of everyone. They could have easily just separated us. I have actually never punched anyone in the face in my life and for some reason just can't do it. So, basically I feel it was an excessive reaction especially since I wasn't even on their property since I was on the sidewalk. I just bought a pair of $60 shorts that are now scratched up because the guy was sitting on my legs and trying to position me a certain way. I don't know if I can even wear them anymore. I think these guys need to be held accountable for their actions and can't just push people because they don't like what they're saying especially when I'm not saying anything personal about him. I think he probably realized his mistake and that must have been what made him so angry. So, that's what I think angered him so much that and that caused him to physically attack me.

I have scratches on my thigh, a big mark on my ankle, strange marks on one shoulder (maybe from pressure because it looks darker beneath the skin), mark on my elbow and pretty gross mark on my tongue. I've taken pictures of most of the marks. The guy that was choking me waited for the police to come at which point he stopped but it took like what seemed like 15 minutes. I was totally lucid with the police officers, not slurring me speech or walking funny. Basically, I didn't feel drunk. I asked the police officer who was going to be in charge of this case and he said "Mr. Vice" and I also got the phone number. Hopefully they were't screwing with me because of Miami Vice and I should got the officer's badge number. I have a number for this "Mr. Vice" as well.

Basically, I want to know if I have a case to press charges or somehow make these bouncers accountable for excessive force. If no one does anything then nothing changes and they think they can get off with whatever they want. I would like to make them accountable somehow and wanted to get a lawyer's take on the situation.
