VerifiedLaw.Hut : Hello: Child-support is based on your actual current income. If you have no income at this time, your amount of child support should be zero. The court as you know is allowed to inpute income to you, and make you pay child support on that amount. I could not estimate what the court might indicate your current income to be. That would depend on any evidence that you are intentionally unemployed or underemployed. If you have solid evidence of your disability, the court Should not be able to include any amount of income to you. I would also apply retroactively. Normally, the court bases an imputation of income on skills, experience or education that the person has which might indicate that they can earn more if they choose to do so. However, evidence of the disability could override all of that, as it is evidence that the person is incapable of earning income, regardless of any such experience or education.
If your income is $50,000, your child support obligation would be $97 per month. The court will not look at your lifestyle, such as the type of home you live in, but only at your income, or actual income earning ability.
