I am sorry that this happened to you.
However, you will not succeed if you sue H and R Block in small claims court unless you can prove damages.
If they are reimbursing you for any additional cost that this is causing you such as the interest you are being required to pay or possibly any penalties then you have not actually incurred any damages. You are being told by the CRA to pay what you owe so that you would have had to pay that amount of money anyway.
The fact that H&R is prepared to give be back the interest plus what you paid them to do the return is at the most what you would get if you went to court.
