Issue- adverse possession. In 2001 I purchased a propertyIn 2001 I purchased a property and now after 17 years I was informed that that part of the vacant land that I have been using doesn't belong to me. I am claiming squatters rights to the land, adverse possession. The property was converted into Qualified Land Title on June 22nd,2009. I need 10 years, but only have 8 years. I need 2 years from my previous owner, but his time may not qualify for adverse possession because he never used the disputed land. The previous owner swore an affidavit in which he denies ever using or allowing the use of the disputed land which he was on title to my property. I came across a case article that settled in the courts which is our own predicament. How can we apply that case to our situation in the court? Under the actual possession, Cunningham v. Zebarth Estate (1998), 71 O.T.C. 317 (Ont. Gen. Div.). Can Cunningham v. Zebarth Estate be used in our case? If allowed to use Cunningham v. Zebarth Estate than we can show that our previous owner meets the requirements for adverse possession. At which point do we need to produce this case to the judge? … read more
