How do i get a mobility issue with my employer tried in a federal court.
I lived and worked in nova scotia for Capital district health authority.
i became eligible for long term disability through a union contract.
i began paying ltd premiums. Three months later i became totally disabled as per CPP and US social security adjutication.
I moved to Ontario when my wifes father was diagnosed with a terminal illness at her request, approximatly 3 and a half months after becoming disabled.
My disability is not compatable with life and I wish to die in Ontario.
After moving to Ontario my Short term disabiity was discontinued for a mirrad of reason one of which is clearly because I moved to Ontario. I was terminated shortly afterwards while I was on sick leave under a Dr. care.
My union greived both issues.
On october 17 2012 I sighned an agreement with my employer and my union that restored my position so that I may finish the Short term illness benefit and than apply for LTD.
My employer has decided not to allow me access to the LTD plan and my union no longer has jurisdiction since the signing of the agreement due to their constitution and bylaws.
I therefore wish to sue my employer for breach of contract for not allowing me access to the mandatory ltd plan and the cause is because im in ontario and there a little annoyed with me.
I also wish to have section 15(1) of the charter applied as i am disabled and wish to access this in ontario if possible can you guide me in this matter?
