Unfortunately, no one can control what charges are laid against someone except for the police. If the police believe they have enough evidence to lay a charge, then they lawfully can and usually will. The way the criminal justice process works in Canada is this:

1) The police investigate criminal activity and gather as much evidence as they can in relation to the offence investigated;

2) If the police believe that they have reasonable and probable grounds to believe that someone has committed a criminal offence based on the evidence they've gathered, they can lay a criminal charge;

3) Once the charge is laid, the matter is dealt with in the criminal court system. Here, the Crown attorneys have authority over whether to proceed with a charge or not. If they decide to proceed with it, then the accused person is entitled to make a decision as to whether they want a trial or not;

4) If the accused decides they want a trial, a Court (sometimes with a jury) will determine whether the accused is guilty / not guilty of the offence.

My point is that it's a complex process, with lots of different things to take into account. A criminal charge is just one step, but there are many others. So, at this point, you'll just have to wait and see what the police charge your son with, if anything.

As for you, if the police are harassing you, saying that you are "hiding" your son, you may want to consult a lawyer to contact the police on your behalf to figure out what the situation is. You're right, though. At this point, you can tell the police that your son has a lawyer, and if they want any information regarding your son, they should speak through the lawyer, and not you.
