I purcahsed a boat that...

I purcahsed a boat that was represented as a freshwater boat by the seller and after investigation I fould out the boat was a saltwater boat. I confronted the seller-who is a marine broker with the information I found and he refunded my money and took the boat back. During the season that I had the boat- it was in total disrepair and I spent close to 9000.00 in repairs plus 3200.00 in upgrades when I got the boat.We were only able to use the boat for approximately 12 hours the whole season due to the disrepair of the boat and the marina cost me close to 12k for the season.The survey of the boat was done by someone who now is a partner in his company. I asked the owner of the company 3 times during the purchase of the boat if it was a saltwter boat and was answered by him that it was a freshwater boat. Do I have a good case against this person and what options do I have to get a refund and what would I been entitled to?

Did he say he would pay for some of the repairs and if so how much did he offer?

My question is since he misrepresented the boat in the first place is he responsible for the payments for the repairs. The repairs were from the fact that the boat was not checked thoroughly by his service staff . He ended up firing the service staff because of this. When I went to see the boat before they transported it to my marina all they did was start the engines and they told me all was ok with all the systems on the boat. the first time we started the boat the navi system died and it cost 2993.00 to replace it. His response about the navi system was I signed off on it and they do not cover electronics. I paid 89,900.00 plus tax which he refunded. He now has the boat on his website for 109,900.00 and is listing all the things that I did in the boat in hs ad.

He has told me he will help me out but will not pay in full what is owed. I have nor transferred title of the boat back to him as of yet. He is goin to call me today to discuss so any help would be appreciated as soon as possible

I understand the question.

I think he must repay you for all the work done and if you went to Court that is likely what you would be awarded. The reason why is that you must be placed in the position you would be in had none of this happened and so you cannot be out of pocket any money.

Had he said all repairs would be made by him and you agreed to this then he could possibly pay what he would have charged for the repairs.

On top of this he is now acknowledging that he has benefited to the tune of $10,000!

So he cannot think you are out the money and he gets to make money off you.

In fact what he really owes you is a boat for $89,000 that is exactly what you were told you were getting.

So if anything he is getting of easy by just reimbursing you for all costs.

So I suggest you do not agree to sign over title unless you are paid back in full.
