VerifiedIn Alberta common law spouses share some but not all of the legal rights and obligations that legally married spouses do if their relationship breaks down.
They do not share property rights. However, if your spouse contributed to the value of property in your name, either through financial contribution or effort, he may have a claim for a portion of the value of the asset.
But if what he paid is equal to fair market value for rent this would not be seen as a contribution to your asset.
He is not a tenant that is covered by the Residential Tenancies Act because this is a shared accommodation so there is no set notice requirement.
You will not lose your rights to the house but it is not a good idea to move out as you are setting yourself up to potentially have to go to Court to get him out.
