If you are working on the space then you can register a builder's lien on title as they you would not be out of time.
Then you would have to sue them in Small Claims Court and get a Certificate of Pending Litigation (Lis Pendens) from the Court Office and register that on title to perfect the lien.
You can send them a letter by Registered Mail. You can set out the facts, make it clear this was not you fault and indicate that while you hope to resolve this amicably you will register a lien and commence legal proceedings if necessary.
Give them a very short deadline to pay you. If they do not then register the lien and commence the action.

And you must start the claim within one year.
