I have a very, very complicated marriage that I wish to be annulled.

I was married to a British citizen in June 2011. Since she was not allowed to
enter the United States, because she was denied a visa, we were married in
Brampton, Ontario CANADA.

During the year we've been married, I've seen her twice. Once when I visited her
in the UK in November 2011 and once when I saw her for a first anniversary in
June 2012.

During this time there was a tremendous strain on our relationship since we had
to spend money for an immigration attorney, we rarely saw each other, etc.. The
visa most likely would not have come through before October 2012 and it caused a
great deal of strain on our marriage.

Anyway, when we saw each other on June 10, 2012 in Canada, all hell broke loose.
I had found out that she had a history of mental problems (Bipolar Disorder)
that she had not disclosed to me before the marriage. I was shocked, and
throughout our many conversations with each other, I had noticed bizarre
ideation including her hearing voices, imagining things that were simply not
there, violent talk about her past, etc.

When i asked her about things in Toronto in June, she got very violent, hit me
and we fought, though I *did not* hit her. The violence shocked me and after her
literally holding me down and demanding that I give her my cell phone, I managed
to get away and she yelled that the relationship is over and I agreed with her.
The surfacing of her mental problems were shocking and I walked out of the hotel
room and drove back to Baltimore where I live.

We have not spoken to each other since June 12. I do not know where she is now
since she told me she "might stay in Canada". Her marriage to me was a fraud
from the beginning and I simply want to end it as soon as possible. She is *not*
an American citizen and we've been married for a little over a year. I had
absolutely no idea about her mental problems at the time of our marriage, and
had I known, I would never have married her. Given her history, I doubt very
seriously if she will even sign papers for divorce.

Please let me know if this can be resolved through an annulment.

If she is going to remain living in Canada you can divorce her in Canada (she
must remain living in one province for at least one year though).

Or you can divorce her in the US.

But as the marriage was valid when you married her in Ontario, you cannot get
the marriage annulled.

Canada recognizes this marriage as valid and therefore so does both the US and
Britain.

But that is not necessarily a bad thing.

In fact, at least in Canada and I would imagine in the US and Britain as well
(should she end up moving back there) getting a divorce is much simpler than
getting an annulment.

In Canada one can get a divorce after a one year separation.

I suggest you speak to a family lawyer in Ontario (if she continues to live in
Ontario) or in Maryland where you live, to figure out what works best for you
given her and your situations.

Service. You will be given the name of a lawyer and can consult with the lawyer
