The Charter of Rights and Freedoms, AKA the Constitution of Canada, is Federal legislation, and any rulings made in relation to constitutional issues are applicable throughout Canada, in every Province and Territory.

So it absolutely relates to the law in BC. If you look at section 172 of Ontario's Highway Traffic Act, you should clearly recognize the parallels between the two Acts. Just because the two pieces of legislation are Provincial, doesn't mean they aren't equally accountable under the charter.

Both Acts permit a roadside vehicle seizure and license suspension, without recourse or appeal. This issue was challenged for it's constitutionality, however the seizure and suspension still continue for the time being, however the application of a potential jail term as a penalty on sentencing for this, an absolute liability offense, was deemed unconstitutional.

The Charter rights with regard to the presumption of innocence remains In relation to the actual offense, as the roadside impound and suspension are not deemed "punitive" but rather preventative measures. Actions such as this can be seen in the roadside or administrative suspensions for blowing a warning and receiving a brief suspension with no charge, receiving an administrative suspension automatically upon being charged with driving while over the limit. These are all done without a trial or hearing.

One thing they have to fall back on is the fact that driving is not a given "right" but rather a privilege that can be revoked or suspended.

Vehicles can also be impounded as a result of disqualified driving charges, prior to the charge being heard or decided upon and such impoundment programs have been added to provincial racing legislation.

Constitutional challenges must always weigh individual rights, public interest, public safety and the administration of justice.

So as you can see, the issues you ask about have been brought before the courts for a determination of constitutionality and for now, such provisions remain valid.
