VerifiedCopperlaw : In order to reinstate your license, you must complete the Responsible Drivers Program AND the interlock program for at least a year
Copperlaw : You cannot get around this
Copperlaw : Since a license to operate a motor vehicle is a "privilege" not a right and the program is aimed at harm reduction, it is unlikely that it would ever be overturned.
Copperlaw : Ti e requirements may be modified, however not completely removed

Copperlaw : If you mean the recent decisions on roadside suspensions, then this battle will likely drag on for some time
Copperlaw : If you had an "impaired" however, and were convicted, then this likely doesn't help you

Yes there is a constitutional challenge that has been somewhat successful. The Judge will rule in June as to what remedies will be available finding a few months ago that the automatic road side suspension BC placed on a "fail" was not constitutional.
Did you get a one year suspension as a result of a court finding you guilty under the criminal code?? Or, is this a Superintendent suspension without a criminal conviction?

The conclusion so far is that if you blew a fail and received an immediate suspension that this move was not constitutional. It does not apply to people who received the same suspension that produced a warn. So, what happened is important because there is no blank cheque.
I have a couple of colleagues who have challenged this. To join, some want $3000 the last I heard.
I cannot recommend any lawyer here. The lawyers on this matter are easy to find with a search online.
