It's not likely that you can at this point.

When were they supposed to pay you back?

When is the last time he/she made a partial payment towards the debt?

When is the last time he/she acknowledged the debt in writing?

What province is this?

Its not about proof.

It's about limitation periods.

In Ontario before 2004 you had to sue within 6 years from the time your claim arose.

After 2004 it became 2 years.

So if the person owed you money back in 2000 and again in 2003 and did not pay it back and did not pay the interest then it's likely much too late to sue now.

If he makes a partial payment to the debt the limitation period starts over.

And that is also true if he acknowledges the debt in writing.

But as far as I can see that is not happening.

So you are likely much too late to sue.

It won't mean a new loan. It will mean you can sue him.

If he just pays a small amount towards the loans that would be good enough to start the limitation period over as well.

That would be fine but I am thinking that getting him to sign something may not work or may alert him to the problem,.

Why not ask about a repayment plan and ask for $100 towards each loan as a start.

It does not have to be on paper but if you can get a witness to his agreeing to pay these small amounts toward the loan, that would be good.

You can also ask for cheques.

Even if they bounce that may be good enough.
