Sorry for the misunderstanding, but the reason I asked if you got my last detailed response was when I opened up Just Answer this morning, my response did not appear. The trees are on their property bordering ours - the trees are their responsibility but in order to bring down/cut down these two massive trees, they need to come onto our property. We sent them a registered letter yesterday which they picked up this morning. In the letter, we stated at the beginning of the letter and in the final paragraph that they would not be permitted on our property unless they had a signed authorized letter from us. We also stated that they are to leave our property in the condition that they find it, as for sure our lawn is doing to have hole and wheel marks from the heavy equipment; all branches and debris have to be removed immediately; they have to give us a schedule that is agreeable to us; any buildings or trees on our property, if damaged, have to be repaired by them; and that the contractor removing these trees has to have the correct equipment to perform this type of work. My question which is the bottomline, can they perform this work on our property without our written consent and if they come onto our property and start the work without our permission, what is our legal rights as a property owner.

There is no fence between our properties. The only clear division is the survey which was done about five years ago when they bought the property. They are very adement about their property lines, which is fine with us. Their property is quite large and they have set up rocks around their property ( which is laughable amongst the people who have seen it) to mark their ownership. They border the town hall, the provincial road, another property owner and us. We respect their property line but they do not respect the property line of any of their neighbours. We have no problem with their property line but as I stated in my last response, what is our legal right as a property owner. Do they have the right to come onto our land without our permission - that is all I need to know.
