I asked my husband for a divorce in Aug. /08. By Nov/08 he had quit work. He declared "You get nothing. I will force you to pay for everything." I have been paying the lot rent on the family mobile home, loan payments secured by the home and all living expenses since that time. In July/09, I was forced to have him removed from the home by EPO. I understand that I am responsible for my living expenses (2 children of the marriage still lived at home). The mobile home sold in Nov./11. Some mutual debts were satisfied by agreement of both parties upon sale.
a) Am I responsible to pay 50% of his personal taxes from prior to separation (even though to date, most have been seized from his bank account by the government)?
b) I made him a reasonable offer for disbursement of approx. $12K remaining proceeds from the home: 50% of lot rent from July/09, 50% of secured loans and town taxes associated with home. His 50% amounts to approximately $21K. I included my legal fees ($2,300 and 50% of the value of the car $2,750 acquired in March/09. (Not including my credit card ($4K and AB Health Care $5K). I offered to settle for the remaining $12K proceeds of the home and to forgive the rest providing he settle without further ado. Is that a reasonable offer? I feel it is very reasonable.
c) He wants me to accept 50% of his personal debt, incurred without my knowledge or approval prior to the separation and 50% of his personal income taxes from prior to separation. Combined 50% of these amounts do not exceed 50% of $9K from my credit card and AB Health Care debt. I have suggested to his lawyer that personal debt cancels each other out.
d) My husband has offered me $1,500 justified by paying his debts and not considering mine OR any costs directly related to the home (lot rent, taxes) or the secured loan since July/09. Is he responsible to contribute 50% of home related costs? Also, he has had exclusive possesion of the car (reg & insured in his name only since day of purchase, indeed insurance cheque payable to him exclusively) since July/09 and wants me to pay 50% of $5,500 loan as my name was on the original loan. Is that reasonable?
