If the father won't consent to the adoption, you can bring an Application to the Ontario Court of Justice to adopt the child, and ask the court to dispense with the father's consent to the adoption, which is normally required.

Father might fight you on that. If he does, have the mother tell him that if he wants to remain the child's father he'll have to start paying the proper Guideline child support based on his income. This won't entitle him to access, as he'd probably come back with the threat that he'll want to start seeing the child. He'd have to show why his access at this point is in the child's best interests which would be a high bar to reach.

Keep in mind that at age 13, the child himself needs to consent to the adoption. If the child isn't aware that you're not his father (it happens) then this is going to be a problem.

There's a fair bit of paperwork involved, and you need to make sure that it's done right the first time. Go see a family law lawyer and if you can, retain them to get started.

If your stepson thinks you're his biological father, and then you have him meet with lawyer to talk about his consenting to you adopting him, it'll be clear to the child that you're not actually the biological father. There's no way to get this adoption done without the child's consent, so if the child thinks that you're the real dad then the child will find out that you're not.

Clearly, if your stepson finds out that you're not his biological father, that could be traumatic to him. Talk to a counsellor about all of this before you start the adoption process if that's going to be an issue.
