Whatever people told you is wrong.

She cannot remove the child without your permission unless she gets a Court Order.

And Courts very often do not allow a mother to move a child. this is particularly true when the father is very involved in the child's life as you are.

For this reason if you can afford a lawyer then you should retain the best one that you can afford.

If not you can self-represent.

For now be sure to tell her that you are forbidding her to leave and that you will seek an order for sole custody if she intends to move the child.

You can tell her that without your permission or a Court Order this is parental abduction.

If you feel she is going to take off with the child anyway and that will be soon then if you cannot get a lawyer you can bring a motion in Court on an emergency, ex parte (without notice) basis, on the grounds that she is about to remove the child from the jurisdiction without your permission and that you have joint custody and see the child at least 2 days a week etc.

The Court will make its decision based on what it finds to be in the best interests of the child.

But the only problem is that while the Court can require the child to remain in Timmins, the Court cannot force the mother to do so.

Now usually this will not be a concern as most mother's won't go in that case but if she says she is going no matter what it may be somewhat of a problem.
