Thanks for your question. Upon termination without cause you are entitled to damages in lieu of reasonable notice. The length of reasonable notice is determined by looking at factors such as age, length of employment, position, duties and responsibilities, and in some instances the manner in which you were terminated. In your case, based on the information provided, it would appear that the length of notice offered is certainly within the range of reasonable. If you were to initiate a claim for wrongful dismissal, the employer would be entitled to an offset for any amounts you make at alternative employment during the notice period. You are obligated to try and find alternative employment during the notice period. What they are offering is pretty standard in that they are trying to encourage you to find alternative employment by only reducing the severance by 50% once you find alternative employment (although there is no guarantee that the alternative employment will be as lucrative as your former employment). With respect to the quantum of your damages, you are entitled to the remuneration you would have received during the 10 month period if you had stayed employed. So it would seem that you should receive the commissions and other benefits you would have received but for the termination. You can counteroffer for these amounts. However, you should be aware that by making a counter-offer you will be considered to have rejected their offer which will no longer be on the table. That being said, most employers usually leave the offer on the table even if you make a counter-offer. I would bring the offer to a lawyer to write a demand letter to the employer proposing your counter-offer to them. A lawyer should also look over any documents they wish you to sign evidencing a settlement of the matter, including a release. Good luck.
