In the Province of Alberta: Is the following clause within a will attempting to supersede the right to contest a will? My question is not raised to contest the Will after death but rather to prevent potential fraud while the elderly person is still living -- and before the elderly person may be declared incompetent which will result in the Enduring Power of Attorney coming into effect. My question is asked as it appears to protect the Executor - the major beneficiary of the Will (97% of the elderly person's assets - including investments, dwelling and all possessions) who has also been designated to carry out the Enduring Power of Attorney. No trusts have been established to protect this elderly person's finances/dwelling - and upon declaration of incompetency by two physicians, this one person has been given complete "unfettered" control -- as stated in another part of the documentation. The elderly person in question is childless, and has been befriended by this Executor/Attorney under the Enduring Power of Attorney -- and spouse -- and has been deeply involved in this elderly person's life since the elderly person’s spouse has passed away. My question is not because of the fact that our family is mentioned in the Will. In fact, should the clause be valid and I lose all that has been promised to my family, I still will not hesitate to take all the steps that I am able -- within the law - to avail myself of any counsel to help me protect this elderly person's estate prior to death. I have known this elderly person and spouse for over two decades. My desire is to ensure that this elderly person will not become a victim of fraud while alive but, rather, that the elderly person's life will be lived in dignity and respect within the quality of surroundings that the elderly person is accustomed to along with top-quality care -- that is within the person's financial capability at this time-- should the need arise. Therefore, this is but one of my concerns.
“I direct my executor that if any person challenges the validity or interpretation of my Will, or challenges my ability to make a Will, or alleges that my Will was made by me under the undue influence of any person, or makes any claim under any statute or any alleged express or constructive trust or otherwise against my estate, then my executor shall deduct from the share of my estate otherwise due to that person all of solicitor and client costs and other expenses incurred by my estate with respect to that challenge. It is my intention that any person who challenges my Will or who makes any additional claim against my estate shall bear the full costs of the challenge, whether or not the challenge is successful. “
This Will was created when the Executor/attorney under the Enduring Power of Attorney -- brought the elderly person to a lawyer to have this Will drafted and executed. Thank you.
