In Divorce judgement, it states, that since I lived in the matrimonial home for approx 2 yrs before divorce, and ex husband was paying mortgage, electricity, and heating; that counted as spousal for those 2 years . After that, there is no mention of spousal.

I have not received support for 2 years since the divorce judgment. We did not go to trial.
Customer:
Yes I did have a lawyer.
Customer:
Finding a job has not been as easy as I thought. I have 5 kids and sole custody. The best I can do is find a part time job. However, minimum wage is not worth it, cause I still would have to pay a caregiver. I cannot afford going to school .
Customer:
I was a stay at home mom for 15 years during the marriage. Many appointments for 5 kids (dental, doctor, optomotrist, ) sick days at school....
Customer:
My ex does not stick to the access schedule. He is 30 minutes to 1 and a half hours not on time and never notifies me.
Customer:
He wants to take me to court to get the access order changed. Will a judge force me to babysit the kids for him?
Customer:
Should I not get something out of that?

But what I don't understand is why this was not addressed and I am a bit concerned because it really had to have been.

Was there a separation agreement?
Customer:
Everything was a court order until we resolved things between my lawyer and him and it was drawn up as a court order. I was the one who applies for the divorce. My ex convinced me to agree to no spousal because he said he would go bankrupt, we had no money, (everything was in his name) and he said that if I wanted the kids, the only way was for me to give up spousal. I left him with my 5 kids and sought help in a shelter for abused women and has a restraining order on him in the beginning. When he makes threats, or I don't do what he says, he makes sure I pay. THat's why I gave in to no spousal. i could not take his abuse anymore.

So are you saying the Order was silent about support then?

It sounds like you gave up the right to support and had legal advice but I am not sure that is the case.

I think that you need to take a copy of the Judgment to a lawyer to review as the facts are not clear enough for me to understand what has gone on.

It will depend on the wording as well.

If may be that you can seek support as you did not settle voluntarily.
Debra Thal (username) :
Or it may be that you can seek support based on a material change in circumstances but the Judgement needs to be reviewed before you can know for sure.
