I live in Dawson Creek, BC. On October 27, I drove to Grande Prairie, AB to pick someone up from the airport. I was a couple hours early, so I phoned the person I was to pick up and asked him if he would be able to drive back to Dawson Creek if I had a drink which he said would not be a problem. I was sitting in the drivers seat waiting and drank some wine. The police were called by, I believe it was an airport parking attendant. While the police were there, the man who I was to pick up landed and confirmed my story that I had no intention of driving. They said that it didn't matter as I was in care and control of the vehicle. I was unable to blow hard enough on the blower to register my blood alcohol, so they considered that a refusal to blow. I received three papers. One is a promise to appear on November 28, which is dated October 28. It lists my offences as 1) Sec 253 (1)(a) Care and Control and 2) Sec 254 (5) C.C. Refusal. The second paper is a Notice of Suspension/Disqualification. It has the box that says "24 hour disqualification followed by a 21 day period, followed by a 3 month suspension or disqualification" and also the box that says "refusal" checked. It also says that a temporary operator's permit was not issued and the reason listed is "out of province". This paper is dated October 25, 2011 (2 days prior to the incident). The third paper is a Notice of Intention to Seek Greater Punishment dated October 28. Also, after being processed, I was given my BC license back and was told that I was not getting charged with an impaired. My questions are: What exactly am I getting charged with? Can I drive? Is there anything to be said about the confusion in dates on the papers? And basically, what is my next step? I've never been through this before and it is absolutely eating me up with worry over what is going to happen. Thank you for any help you can offer.
