It's not likely that a Court would agree to make an equal division of family assets in a case like this.

This is, in fact, a prime example of when a Court will not make an equal division because one spouse dissipated the family assets.

Gambling is the strongest case of the unequal division of family assets to be ordered for a dissipation of family assets argument.

So you can retain a lawyer and hope that makes your spouse feel that some sort of compromise is better than going to Court (and frankly it is because if this ends up in Court the winners are the lawyers) but I am sure your spouse has been told her position is very strong.
