I just want to confirm. He cannot claim the childcare expenses? We don't split that cost? Is that because I have more than 50% custody of the children? Under what circumstance would he claim the children or one of the children as a dependent?

If you have sole custody and he pays child support then he is prohibited from claiming the child care expenses.

If there was a joint custody situation then he could claim one of the kids but there's not.
