My law question has to do with how insurance companies decide who is at fault regarding a claim.

My son was in an vehicle collision, an insurance employee decided that he was at fault.
I was surprised and asked for the rationale of the insurance company and was declined. I persisted and subsequently received information that the insurance employee had falsified.

I followed up with her direct supervisor, after several months (Feb-April), he offered to reimburse half of the deductable but maintained that my son was at fault because he was driving the speed limit and it was winter.

As customers, we want to be treated fairly--a ford escape cut sharply into my son's lane from from a stationary line of traffic. My son was driving the speed limit with the routine flow of traffic and then braked to avoid full collision with the ford escape but ended up hitting the front fender and sliding into an innocent third party. While determining the well being of the individuals in the third party the ford escape that caused the problem left the scene.

The supervisor indicated that my son and all the cars in Calgary should be driving slower than the speed limit (but would not give a precise number)--or they are at fault by Alberta law.

Is this really the law?
