<p>I'm US citizen (husband) , lives in VA US since 2005.Married a Canadian Citizen (Wife), we have a US citizen child daughter. In Sudan our back home me, and my wife had a marriage ceremony contract according to our religion in December 29, 2007. In the cityToronto, Ontario, Canada we did the marrage in April 10, 2008 in front of Rev.Me and my wife traveled back home to Sudan, and celebrate the wedding on December 27, 2008 In April 18, 2009, my wife came from Toronto Canada with a visit Visa to live with me in Herndon VA, while I was applying for her US green card which she received in June 2010, and she received her SSN in July 2010. </p><p>On Saturday July,27,2010 my wife step mom brother who lives in Woodbridge Va US came to my apartment while I was away and not present in my apartment, he took my wife, my daughter, and their bags in his car traveled them to Ontario Canada where is my father in law lives with his family.</p><p>On Monday August30, 2010 I received an express mail at the Arch stone where I live at the lease office from my wife, inside the express mail envelope I found documents from Ontario Canada Superior Court Of Justice Family Branch the papers telling me that my wife filing a divorce, claiming divorce only from me, and a court case has been started against me no court date has been set for the case. The papers telling me, if I want to oppose any claim in this case I must prepare an answer, and I have only 30 days after this application is served on me (60 days if this application is served on me outside Canada or US) to serve and file an answer. </p><p>I did not take any action regarding my wife filing divorce in Ontario Canada. I made many phone calls, email messages to my wife as well as to her father, expressed my love, my care for my wife, and for my daughter, asked for the keeping our marriage life, but I got no response for my requests, my father in law, and his wife kept telling me about I should give my wife the divorce, because my wife wants to go to London UK and work as a doctor in a hospital in London UK. </p><p>In November 2010 my wife called me from Scarborough Toronto Canada and told me that she traveled to London in August 28, 2010 only by herself, and left our daughter with her step mom , to do a job interview, she got a job offer in London, she wants to apply for work permit in UK through the British embassy in Canada, she wants me to send her a notarized consent letter for our daughter to travel with her , and she wants my bank statement which will proof that I will support our daughter financially. I was very kind and generous, and sent my wife the consent letter for our daughter to travel with her to London England to work over there, I told my wife to inform me about her address ,and where she lives so I can know about her and my daughter. </p><p>After my wife received the consent letter , and my bank statement, she stopped calling me , not replying to my email messages in which I asked her to tell me about her travel , address , contact where I can know about her, and my daughter but totally she ignoring me till today and I do not know anything about my daughter. I knew lately with a help of one friend lives in Toronto that my wife is in London working in a hospital, and our daughter with her. </p><p>In February 16 or 17, 2011, at evening time I was going outside of my apartment , I opened the apartment entry door, suddenly an envelope fallen off the door on the floor , the envelop was a Canadian Express mail hanged on the door. I picked up the envelop, opened it, found documents from: Ontario Court of Justice atXXXXXEast, Toronto, Ontario, The document telling me that a court case has been started against me and the first court date is April 06, 2011. This case includes a claim for support. It does not include a claim for property or exclusive possession of the matrimonial home and its contents. My wife asking the court for the following: 1. Order for sole custody of our daughter 2. Order for child support in accordance with the child support guidelines. 3. Order for supervised access for the respondent. </p><p>I’m asking you as an attorney to give me the right consultation, and the legal direction about: </p><p>1. Are yu experienced in divorce cases between American and Canadian citizens. </p><p>2. The way I received the court notices is that right way I served? </p><p>3. What are my legal rights for the custody of our daughter ? </p><p>4. What should I do for the claiming divorce case in Ontario Canada is there jurisdiction over me as an American? </p><p>5. Can my wife have the divorce from Canada? </p><p>6. Will I pay for child support in accordance with the child support guidelines, even my wife she left to Canada, travelled to work in London England, and took our daughter very far away from me? </p><p>7. If the divorce happen what I can do to get my daughter back? </p><p>8. If the divorce happen what is going happen to my wife green card?</p><p>9.
