Here is some back story. In August of 2019, I moved into a 3Here is some back story. In August of 2019, I moved into a 3 bedroom apartment on the second floor in a semi-detached duplex house. The landlord only allowed 1 person to be on the lease and act as the leaseholder. The lease was signed in September. So, the other new tenant and I signed a roommate agreement with the new Leaseholder, (she had already been living there for a year). During the summer of this year 2020, the other side of the semi-detached duplex house, which the landlord (does not own), started reconstruction. This was the start of a horrible living situation filled with constant construction-related issues. Which include, but have not been limited to: the house shaking new cracks everywhere daily noise pollution lights falling out of the ceiling raccoons keeping us up at night (running in our walls for weeks + this has started again) water cut off for 8 hours with no notice motor fumes in my room the smell of our own sewage wafting through our air vents for 5 days A power outage in my room that required the landlord to come and fix it, granted it was in a timely matter, but my room controls the wifi for the whole unit, so not ideal during work hours. One of the rooms now has weird pooling in the ceiling, probably construction-related too. So the leaseholder decided she wanted to move out and gave her 60 day notice on the 1st of Oct. The second roommate also decided to move out at the same time. After the 1 year of the lease, we were on a month to month basis. The landlord asked if I wanted to take over the lease, and I said yes, so we let her know right away. So during the month of October, she asked me for all my documents and dropped off the rental application. My new lease was going to start on Dec 1st as that was when the old lease would end and the date my two roommates were moving out. The month of Oct. is where we all noticed how the nonstop construction problems were picking up. I'd like to note, that during this month she reached out and offered us a $200 rebate for the months of Nov. Dec. and Jan. So we would be paid $200 back for Nov. as that was our "last months" rent. I started negotiation a new lowered rent for the new lease, as the property value had gone down and I hadn't signed yet. She said she would think about it, and get back to me. So I started doing virtual viewings of the home, because I wanted to get a sense of the demand, before becoming the leaseholder. The landlord is aware I am doing a roommate search. So on October 31st, she comes over and drops off the documents for our current leaseholder to sign and end the lease. Then she speaks with me and lets me know due to all the construction-related issues she has decided to sell the home, as this is a battle she can not win with the neighbors, and is concerned about the safety of our home, and doesn't think it is fit for living anymore. I can not argue that and I agree. So she gave me 60-day notice that I need to be out by Jan. 1st, 2021. She said she would bring paperwork for me to sign later on to make it official. Where I am now: I recently learned about what an N12 is, and it says I'm entitled to 1 month's rent. Would that just be my portion of the rent, or the full rent for the whole apartment, as I am the only one getting evicted? Rent was always paid as a whole for the unit never individually per room. I was not on the previous lease and right now there is no lease. We have a good relationship, with open communication. We have had a lot of communication back and forth especially as of recently with all the problems and lease negotiation. She has always acknowledged me, as a tent in the home. Also, she has been fully aware that I was a tenant since the day I moved in. I am asking what I should do because $815 back isn't much compensation for the inconvenience of getting evicted during a pandemic and the holiday season. Am I entitled to an N12? Should I ask for it?
