i have a fence that...

i have a fence that was erected before i bought the property about 16 years ago. aparentley the fence was built over the line about 6 inches and was agreed to by both partys at that time and was regeristed in the county office. my question is does the property line now extend from the fence out to the front of the property or does it jump back into the orginal line half way across the property.

I cannot follow the facts as I can't picture what you mean.

But, basically are you asking if the 6 inches now belongs to the neighbour?

And, what exactly was agreed to and registered?

And, what province is this please?

OK, The Province is Ontario, Halton Region. The first section: There is a pre-existing fence between our two properties which divides the back yards of our respective houses. This fence existed long before either one of us moved into the area. The Neighbour is trying the claim that that fence is on his property. That fence has already been registered with the county office. The Second section: He is currently building a new fence starting from where the old fence ended and wants to build it out to the road. He has started building the new fence starting at 6 inches offset towards my side of the property and building out. I would like to know if that 6 inches of property belongs to me? If so i would like my neighbour to remove his fence from my property.

Do you mean the deed recognizes the property is yours or that there is some easement or right of way or are you just not sure?
