I am sorry to learn about your very unfortunate predicament. The police are taking the position that you should have known that your designated driver was impaired and that you should have ensured that this individual had a valid driver's license. The person was a stranger and not a conventional designated driver because such people don't drink and are usually known to the drinker or drinkers. The interesting thing is that because you were inebriated you may have lacked capacity to be responsible for making those decisions. On the other hand, it is also possible that a court may rule against you because it does not want to reward what it may characterize as irresponsible conduct.
I suggest that you immediately retain a criminal law lawyer to act as your advocate at the appeal.
