VerifiedIt's not likely that you will be able to reduce the child support at this stage of your life unless you can prove that retirement is necessary based on your health.
When a parent has an obligation such as the ones you have the Court will usually impute income if the paying parent is intentionally under-employed or unemployed. So, you will have to prove that your retirement is necessary and not voluntary in all likelihood.
As well, even if a Court decided not to impute income, if the income would be not taxable then you would have to gross up the amount so that the $50K would be used as net and not gross.

I have three children ages 14, 19 and 21. They spend 50% of their time with me and 50% of their time with my ex. I currently pay child support for all three children. The two adult children are in university and often complain that their mother does not help them with purchases or spending money. I had asked my ex for both of us to put in an equal amount as an allowance for the adult children to help them get by. My ex refused. Both adult children have part-time jobs but this brings in minimal revenue as their focus is university and does not cover for their basic teenage needs. Through the judgement of divorce, the children's tuition is being paid through a special fund (RESP) that my ex and I had invested in while we were together which has matured a few years ago. All this to say that the children's education cost does not factor into the child support payments because it is handled through this RESP money. I currently pay $875 per month in child support. The question I have is that according to my adult children, they receive little or no help financially from their mother so I feel it is unfair as the money seems to be going to my ex for her personal use (a significant portion of it at least as I realize there are recurring child support costs such as groceries, for example).
