I am looking for advice regarding a dispute I am having with the condo board about my parking space. Here are the facts:
- I own an apartment atXXXXXSE in Calgary. I also own an underground parking stall in the building. My wife is co-owner.
- We also own a house in Shawnessy. The house has been our principal residence.
- The apartment was rented for about three years until this summer. The former tenants left and I announced the board/management company that from now on the apartment will be owner occupied. They returned the rental security deposit to us and in turn we returned it to our former tenants. All utilities are now under our name.
- My mother moved in the apartment and lives there full-time, that being her primary residence. She does not pay rent or maintenance. I and my wife pay for everything.
- I, my wife, and my daughter treat the apartment as our secondary residence. We go there almost daily and sometimes stay overnight, especially our daughter.
- I and my wife own two cars, registered and insured at the house address.
- I and my wife commute to work daily by C-Train. Somerset LRT station is across from our building.
- Most days while we are at work we park one of our cars in our stall in the underground parking.
- While we are away we want my mother to have access to a car in case of emergencies or various needs for she and our daughter.
- The parking lot also has a separate visitor area. Owners/residents are not supposed to park there. We never did. Also, C-Train parking is prohibited in the visitor area.
- The condo by-laws state that only unit occupants may park in a designated parking stall. So, non-resident owners cannot park in their own stall even if they have title. Stalls cannot be rented to other than residents nor sold to other than owners. An "occupant" is a person as indicated by an owner.
- Based on the by-laws, in our case, the occupants of our condo are the four members of our family. Only we are allowed to park in our stall, while we are not allowed to park in the visitor area. Once we established these facts, questions about how often, when, and why we access our apartment and our parking stall are irrelevant, in our opinion.

What happened:
- Last week we found a parking notice on our windshield. The notice stated that only residents can park in an owner's stall and that commuter parking is not permitted in the visitor area. The notice indicated a phone number for the parking committee to call and clarify if we were in fact residents.
- I called the number immediately and informed the person, Brian, that we are owners/occupants of the apartment, that the apartment and the parking stall are not rented, that we have the right to park in the stall at any time, and that we were not parking in the visitor area.
- Instead of acknowledging the information to further verify it with the board or the management company, Brian from the parking committee proceeded to ask me about personal and familial arrangements and commuting habits, told me that he has been watching us coming and going, and asked me to read the owner manual where "commuter parking is not allowed". I tried to explain the situation again, at which point Mr. Brian hung up on me.
- When I got to the apartment I consulted the owner manual and the bylaws and found nothing to support Mr. Brian's position. I called him again and read to him the pages regarding parking. He stated that I am missing a page and that he will ask the Board to send me an updated copy. While I was trying to calmly respond and clarify, Mr. Brian hung up again.
- I called him one last time to ask why did he hang up. He accused me of ranting, lying about my residence status, and harassing him with too many phone calls. And he hung up again.

Complaints are supposed to be submitted to the Board in writing. My problem is that the Board seems to misinterpret the bylaws. They say that an occupant is a person authorized by an owner to reside on the premises. Only occupants are allowed to park on own stalls.

Mr Brian is apparently an owner that sits on the committee and is member of the Board.

The management company is also trying to explain me that I am not allowed to park in my own stall because I am not a full time resident. They gave me an example where an old lady resident has a parking lot but her daughter has to park in the visitor area when she visits to take care of the senior.

In my case, WE are the owners and part-time residents taking care of a senior which is full-time resident. I feel that everything else they are asking is breaking privacy laws.
