I was awarded a piece 1/2 acre of treed land in 100. mile area…

I was awarded a piece 1/2 acre of treed recreational land close to 100 mile house in bc Canada area, through my divorce settlement 5 years ago. I was told by lawyer that I had to have the property transferred over into my name my self, as it is only in my ex-husbands. but when i tried and sent all needed and filled out papers in, twice actually to BC Land Title and Survey office which is in in New Westminster BC to transfer the property to my name, i kept getting back from the office the response that said or informed me thati needed the original duplicate certificate of title or i could not get it transferred. I guess i only have a photocopy of a paper which is what the office told me it was a photocopy now i am not sure it is a copy of the same thing. My ex said he does not have it.

I have been paying the taxes and they are up to date. My ex recently tried to get me to sell saying if we both signed papers we could sell to a interested buyer my ex had real estate papers filled out ready for me to sign he had been offered a price from a buyer. i was told this through my daughter by e-mail message that he was on his way over the next day. but i would not see him he was going to come over to coerce me into signing real estate papers to sell the land i felt. He would not correspond with me on his e-mail at the time as i messaged him telling him no and asking him to help me and i told him he was greedy and not entitled and i was angry and did not want to see him in person after 7 years.

He is not entitled to anything from or about the property but i had been behind on some taxes at the time and paying in a few months before time was up they are now paid in full. i have no intention of selling the land at all ever at this point even though i have no money really or any assets.

How do i get this land in my name. He will not cooperate in anyway to help me. I have sent him e-mails and he wrote once at that time saying he would not ever help me thought would could be friends if i sold it but now no i do not care to be his friend anyway. I don't understand how without that original duplicate certificate of title that i am told i need that we could sell at all to anyone even together us signing real estate papers. i do not know if we ever had it or just a photocopy of what i have. i was quite young when we bought and i put only in his name he was my boyfriend at the time.

It is still in his name but divorce papers say it is mine but i have to get it in my name myself he had signed a paper at the time of the settlement that was given to me for me to transfer that but it did me no good as it was not the original duplicate that i was given back. He found out the land went up some in value and he thought i would give him half of the selling price. i actually paid for all of it myself through the years in payments. which does not matter but it was paid 14 or more years ago. At one point we tried to go to a notary to get it in my name but the seller to us or to legally my boyfriend told he notary that we never paid it all in full and said it was worth 5 times more, which was not true it had barely gone up in value at the time. the notary found there was a mortgage still held on it by that seller to us but i wrote that seller and he never returned a response. He was an ass and old but a younger wife who at one point tried to buy it back for 1/2 of what i paid it was worth mor and that was because of checks that bounced because she saved them up to cash a lot at once trying to scam us she was nasty too. I think they divorced and he may be dead but was told by lawyer after 5 years of no contact he could do nothing anyway even if he had a right which he was lying about me not paying it all. i have most checks but did lose some in a break in at one point I do not know why they were taken or destroyed just stupid neighbor kids i think broke in tor our place apart at one time so ripped up a lot of stuff and they probably got thrown out anyway i have most of them from the years.

That was 7 years ago at the notary we tried and she talked to that seller i had payed the land off years before that I never heard from that seller since & never heard from him for years before, he just cashed checks. But he did not write the agreement as it was supposed to be originally decided it was to be for 8 yrs at 80.00 a month for so much interest. he wrote it at 11 yrs for 60 a month for different interest. payments he was trying to scam us and so i made the higher payments for shorter time as i was told by his represenitive to do and would be fine. At times he or his wife never cashed checks a few times at a time saved them up than cashed altogether never said they would do that and of course they bounced but i paid all those plus 25.00 fee for every one of the checks to him which was in the agreement if that happened he had postdated checks for a year at a time. I did not have it put it in my name also at the time as I thought at the time it would be better in just my boyfriends. I trusted my ex to sign it over to me if we did not marry or anything happened, it was stupid of me. He later after 18 years together and 7 years ago ran out on me and paying his share of all the bills we had including a home which we ended up selling to pay a consolidation loan off and nothing left over from the house, he had a new girlfriend who owned a home who he later married. so i got the land in the divorce agreement or so it says in the papers.

anyway the question is how do i find a duplicate of the original certificate of title and get this property transferred into my name or without that duplicate certificate can i somehow have it transferred to my name. i had given him all the papers on the land to give to his lawyer when he left me as i had always kept them as he said he would do that and have it transferred but he left it up to me in the end and in the divorce papers and i got back everything of the papers i gave him i thought not sure really, but the duplicate original certificate of title for the property is only a photocopy. Everything is very worn out as far as the papers except that photocopy as it was in 1986 or 87 or 89 i have to check, that we bought. the land in the first place and i started payments on it. Is there anything i can do about this easily. The land is near a lake but not to close or on the lake and is only 1/2 acre it is not worth all that much but is all i have and i bought it for me in the first place to camp with my kids while they grew and older. children that i had from previous marriage. it also may be my retirement money or handed down to my kids. what i really have as far as a copy of title as i have checked now, is a photo-copy which is a copy of State of Title Certificate. it is stamped from Kamloops land title district.

I know my ex can not sell it; but, he is causing me major stress and now problems with my children. How can i get the original duplicate Certificate of Title that i need. Is this copy i have a copy of what i need of an original of. or is it not even the same thing at all. Like i say if my ex is telling the truth than we may never have had the right paper ever and were only given a photocopy of this paper i have and I mentioned. or he has lied and gave me a photocopy of an original of this & he has or has another paper. I thought somewhere here i have the deed that is in my ex's name but i have not found that either. Can you help me with this. Thank you.
