In Ontario the law generally is that an engagement ring is considered to be a conditional gift.
The gift is conditional on the marriage taking place.
But, there are cases where a Court only orders the ring to be returned if the ring recipient is the one who calls the wedding off.
In a case like yours, it would seem that the cheating could be interpreted as an act of calling the wedding off so it's not completely clear that in a case like this the ring would indeed have to be returned.
