Spousal support JA: The Lawyer will need to help you withLong term marriage. Husband, remarried, 65, wants to retire, makes $200,000. Wife 63 on disability for over a decade gets $2,000/month taxable from 2003 order. Husband claims health issues wants to terminate spousal. Wife has no other income. In 2008 in mediation wife lost all retroactive ss and was to be arbitrated for ongoing increased spousal. Wife health worsened did not put into court. Asked husband for help. Husband refused. Wife continued to live on second hand everything, struggled to survive. Now husband expects her to live on CPP disability amount of $12,000 till reduced at 65 then OAS starts. Husband has a cottage, RRSPs, able to pay more as he lives with new wife in million dollar house and will very likely consult after dumping spousal support responsibility. Wife lives alone, never remarried. Has some RRSPs, far less than husband and she has no company benefits, nor any company pension. What would be the precedents in this case? Should I go to arbitration but husband can back out of that too, like he did twice sine separation after two mediation agreements between opposing counsel and parties?
