If your name is XXXXX XXXXX the deed, then you are not legally a 'joint owner' of the property. You have a beneficial interest in the property because of the fact that you are married to the title holder. However, if he passes away, if the deed or title is solely in his name, the property may well be sold and divided under his will. You would need to take steps to prevent that from happening legally and the matter may well end up in court.

You can file a change of title with the land title office which would be a very good idea. You can change the title to be registered as a 'joint tenant' on title with your husband. If that is done, you would be entitled to the entire interest in the property upon his death and the home would not form part of his estate. It would remove any argument in that regard.

As well, if your husband has not made adequate provision for you in his will, you may well be able to contest the will. That also would require litigation though, and it would be better if your husband rethought the provisions of his will to ensure that adequate provision is made for you.
