If you have been the primary caregiver for your son for the past year, it is likely that you would be given custody be a court – the court would likely find that the status quo is in the best interests of the child if that has been the arrangement so far.
So that you are aware, there are other arrangements available as well, including a joint custody arrangement with one parent having primary care of the child.
With regard to the other issues relating to your separation I would strongly suggest that you see a family lawyer to meet and discuss all of these issues. Aside from the custody issues, there are child support issues, property division issues etc. that should be dealt with.
