My wife and myself are Canadian citizens working overseas. My wife officially returned to Quebec, Canada in July 2009. I am still working oversea. Our marriage has been troubled for over 10 years and we decided to divorce. Under advice from my wife's lawyer, we have to wait until my wife has completed 1 year of residence in Canada before we could file for divorce.
Meanwhile, the lawyer successfully filed to Quebec Court a Separation Agreement, which became effective Dec 26, 2009, subject to a substantial settlement to cover the division of assets plus a large amount to cover the cost of living for our 4 year old daughter until she reaches 18: I already paid such settlement to my wife in december 2009.
Since then, I have been pushing my wife to complete the divorce process as I need to rebuild my life overseas with another woman I met oversea, with whom I plan to marry with at end of Dec 2010.
However my wife's lawyer advised that we need to wait until my wife finds a job first before we could apply to the Quebec Courts for a Divorce: the lawyer argued that the reason for the delay is that the Quebec Court would not require me to pay my wife a food pension as a condition of the divorce.
I don't understand this argument, as the settlement amount of money, which I paid to my wife largely covers any food pension for her and for our child for the rest of their lives. In addition, my wife has left the job market (she is an engineer) for over 20 years and at her age (55) finding a suitable engineering job could take years.
