The bank will take what is owed to the bank if the bank has access to the funds.
If there is is to be an estate account it's common to give the money to the estate lawyer to be held in trust.
This helps prioritize the need for funds in terms of expensives, short-terms pressing fees etc.

When the funds are taken from the persons account does the estate account have to be in an institution they already have an account in?

As the executor of an estate, can I legally move money from one institution to another. Without getting into trouble?

This money would be moved before an estate account is set up.
