The difficulty with attempting to end the contract now is that it may give rise to a cause of action against you by the realtor. If there is a reason in law for terminating the contract (ie. it is "frustrated" because it cannot be performed, the realtor him or herself has repudiated the agreement, etc.) then termination would be fairly simple. Such grounds do not exist on the facts you have set out. As well, there are certain things the realtor will have done now in listing the property on MLS, perhaps privately, discussions with others, perhaps some showings etc.

The better course is to renew the agreement with the tenants with the right of first refusal starting August 1, let the listing agreement and 60 day period expire, the complete the sale. The difficulty with that, of course, is that the sale could not complete until early next year.

It may be that a detailed examination of the documentation, the circumstances surrounding the signing of the listing agreement, and the efforts that have been put forward by the realtor so far would produce some ground for termination. I would recommend that you see a lawyer in your area for some advice in that regard - he or she will have the benefit of being able to sit down with you and discuss matters in more detail and examine the documentation.

Of course, the agreement can always be terminated by consent. An offer, through counsel perhaps, of compensation to the realtor for the efforts put forward so far may bring a result, but that can only be determined after an examination of all of the facts.

This particular area is fraught with litigation between realtors and homeowners. I would strongly recommend speaking with counsel in your area before taking any step that may even be construed as a desire to terminate your listing agreement with the agent.
