We were told by the landlord assoc that it was against the law to turn off the heat prior to June 15 so why do you say March 31st? She only contacted social services once causing them to waste time with an investigation. How about making a false charge against me with Childrens' Aid? Even the rep from Childrens Aid told us that it was a total waste of her time coming to check up on my child when she could have been investigating a real problem? I have witnesses that were there when the landlord and her daughter lifted up furniture and dropped it between 11 and 6 knowing full well that we were sleeping below.

I am beginning to wonder if you read my question because it clearly states that I "lived" there until May 31st so to your response...I have moved already and she made the false accusation with Childrens' Aid a week after I had moved to another location. I moved because of all the harassment I have been experiencing. She, also, had problems with the previous tenants.

Thank you so much for your response Ms Thal. I am feeling so frustrated because this has gone on and on. Where the harassment took place was in Pickering and because of it we had to move out and found a nice place in Oshawa (not a basement apartment). My mother told me that it was against the law to file false charges with the CAS. I was very upset because I look after my son very well and that is what the CAS rep saw when she came over yesterday.
The harassment has gone on since February 2010. When she turned off the heat in the basement appt my mother was furious so she called the Town of Pickering and told them that it was freezing in our basement apartment (she lives out of town). They told her that the landlord is not allowed to turn off the heat until Jun 15th. Someone from the town came over and took the temperature in several place in the apartment. It was 60 and 62 degrees and I had a child! They made her turn it on, however, she then turned it off again a month later. The fire marshal was contacted because it was an illegal apartment and told her that she had to do quite a few things to have it as an illegal apartment and this was when the dropping of the furniture between 11 and 6 am started.
This morning I went to see a mediator at the tenant board to see about the interest on the last months rent but it was so little that the mediator told me not to bother. The landlord kept interrupting the mediator and he was getting angry. At the end she asked him where she could go and apply to small claims court. So I know that this is not over. It keeps going on and on and I moved out over a week ago and still she is coming at me like calling CAS on me.
I have the number to the tenants board but they told me to just file the forms but they never did anything about the harassment that I had gone through. That initial meeting was in April I believe. I don't think that they can do anything about the harassment...at least they haven't so far.

If the landlord takes me to small claims court can I counter sue for the harassment that I have been going through?

I actually have everything documented (my mother typed it up)when I first went to mediation at the landlord and tenant assoc in Whitby in April but I was never allowed to say anything about what I had gone through.

I'll try the police, however, I don't think that it's going to stop her from the harassment. I work full time as a hair stylist and have to take time off because of all of this... Luckily I have an understanding boss.
