Sorry, ma'am, misinformation on my part, if you were to look at "CROA 2688" on the web or at CROA.com my situation started there. Then there was a series of medical leave of absences where I was cleared to return to work with just one med.(physical) clearance...in 2000 I was cleared to return to work after the pacemaker install with just a physical med clearance...for the accommodation agreement - no medical clearances were introduced at the meeting...I was there, but I was mentally incapacitated and didn't know it (after my recovery I retained all memory of my experiences, don't ask me why, guess only a shrink can answer that. I went through the grievance period and between the the beginning of the griev and Arbitration CROA 3250 I recovered 100%. Employer was aware of it...my recovery date was June 29/01...CROA 3250 was May/02. Employer and union signed off on CROA 3250 saying that I was still mentally incapacitated when no such condition existed. They were so busy trying to cover their butts they didn't pay attention to the dates.

Just after the signing of accommodation agreement I screwed up at work(suffered a mental lapse which affected my judgement all due to my mental health at the time). I am assuming that when the employer did their investigation they found their mistake and persuaded the union to cover it up with manipulating at CROA 3250. My efforts to have this brought back to arbitration failed. I was ignored by the union from 2002 foreward....it took me quite a long time to figure out what was done and how...I did up an affidavit (with all the documented evidence and medical docs) for presentation to the arbitrator , but I was prevented from giving it to the arbitrator.

I was fired recently on an unrelated incident CROA 3823 , which I believe was a maneauver to get rid of me because I am a liability to the adminstrative people who are still worrying about what they did...CIRB turfed my complaint so now all I have left is a lawsuite to pursue if it is a good way to go...got no money but maybe I can nickol and dime it most of the way

I am in Edmonton Alberta....the best answer I can give you is that it took 4 months of intense group therapy to release what caused my mental illness (when I was 5 years old I witnessed a man stabbed to death in a drunken fight in an army camp [Ontario Northern Territory, Due Line... approx around 1955). The trauma knocked me out and I remembered nothing until it was brought out through treatment...so, from this trauma mild depression was progressed, through to major depression in my teen and part of my adult life and than clinical depression...which included

amnesic episodes which happened at work and is responsible for my mistakes and incidents at work....so when I recovered and was discharged from the medical treatment program with no psychiatric restrictions....I was in a convalescing mode for quite some time (the convalescing period was to last for as long as the period time wise as I was mentally ill...which is some 40 years...and this is from the psychiatric team I had to work with in treatment...so if you can somehow imagine what kind of natural high I was on for the next 2 years (coming out of a dark bubble to sunshine that lit the very core of my soul) ___it is this period of time that I somehow realized that something was wrong with where I was supposed to be at work (a major foreman on the railroad) and somehow I was demoted and restricted and could not go back to work as a foreman, but could only hold a position in my lowest seniority group....my natural high diminished to a low ebb and I have spent many hours researching and attempting to put together what really happened...so on that note I have to say as long as 2 years and I did write letters to the union telling them to return to arbitration and straighten the mess out...but I was ignored and treated like I was not capable of understanding that nothing could be done...I did put together an affidavit with the help of lawyer/arbitrator (who is associated with the union in question but in the distant past and couldn't go any further with her help or advice) which is the backbone of my case...doc's, dates, events and all in chronological order...both parties now have copies as I had to provide CIRB a copy...so evrybody is on the same page and now it's a matter of time when the next blow is going to come...they know I know what they did...I attended arbitration in Montreal in 2008 (CROA 3250 supplementary) to have myself reinstated as foreman....just before going into arbitration I told my union rep that I was presenting an affidavit to the Arbitrator to get the mess straightend out....the union said to me at that moment that if I presented the affidavit the union would walk and that my union file would disappear forever...so I backed off because it scared me to no end....I realized later that I didn't need my union file or the union....my employer medical file has all the eveidence...
