An Ontario judgment lasts for 20-years. You should ask the collection agency to receive a copy of the default judgment. The judgment will contain a court file number and you can search the court file to obtain a copy of the Statement of Claim and the affidavit of service relating to your alleged receipt of the Statement of Claim. Invalid service (i.e. not being served with the Statement of Claim) is one ground for setting aside a default judgment. You need to move immediately to set aside a judgment.
You may want to retain a civil litigation lawyer with debtor-creditor experience to assist. The Law Society of Upper Canada's Lawyer Referral Service can provide you with names of lawyers in this field. If you retain a lawyer, the collection agency will be compelled to deal with your lawyer and not you in accordance with the provisions of the Collection Agencies Act.
