Are Property Managers in BC considered agents And if so, are…

I have a single townhouse that I own and have rented out through a Real Estate/Property Management company. There have been numerous complaints about my tenant from the strata corporation, and numerous times when the tenant has not paid rent on time, often more than 25 days late. The management company took a very relaxed attitude towards this tenant and allowed them to pay late instead.

I requested the management company to serve the tenant with a 10 day notice to vacate due to failure to pay rent. This gives the tenant 5 days to pay or to file a disupte with the RTO or they must move out on the 10th day. This was done, grudgingly, by the management company, but at the end of the 10 day period nothing happened. I called them and asked what the situation was, and they asked if I wanted to apply for an Order of Possession on the property. I am not sure the company actually told the tenant to move out. When I answered in the affirmative, they then called the tenant and told them that they would be evicted IF they did not pay the rent. The tenants later paid, but by this time I had had enough and wanted the tenants to leave.

These same tenants have also incurred several fines from the Strata corp for disturbance in the property, keeping a dog in the unit against the agreement and failing to clean up after it, and parking in restricted areas on the property. The management company has told me that they do not want to pursue the matter with the tenants at this time but that they would recover the cost of the fines from the tenant's damage deposit. The trouble is, the fines are now more than the damage deposit on file.

My question revolves around the fact that the company seems to be working for themselves, doing the least amount of work possible and not reflecting my own desires towards these tenants. I feel that there are sufficient grounds to evict, and that the fines, by our rental agreement with the tenant should be the tenants responsibility. I feel that the management company is working for their own ends and not mine.

Does this not go against the concept of agency? And are they responsible for acting in my interests in this situation or their own?
