We hired a company to do our master bathroom renovation pluswe hired a company to do our master bathroom renovation plus install a second bathroom in our basement. We signed a contract and paid 40% down. The contract included another 45% payment due upon delivery of custom cabinets. During the renovation we had a flood from the plumbing installed in the master bathroom through the floor to our dining room. We also had many issues arise with the quality of the work done including walls being out of plumb, tiles not cut and installed correctly, forgetting insulation, to just name a few. We have a list of over 15 mistakes/errors/omissions We had a written schedule for work but many days passed without workers showing up...when they did they worked a few hours then left. It's been very trying. We asked the owner to the site and discussed our concerns. He did remedy most of them. Currently, we have most of the cabinetry installed. Not all tile in the shower is complete. Since the cabinetry has been delivered the owner is demanding due upon delivery payment. We are concerned we will pay him and then we won't see any more work completed. Still remaining is installation of toilets, shower fixtures, sinks and fixtures, bathtub, electrical fixtures and trim. We have been in discussion with the owner to discuss our concerns and want to balance our risk and obligation with him. We have offered him less than the due upon delivery with indications for him to complete plumbing, tile, trim and fix our ceiling which was damaged from the flood. We've offered him the balance due upon delivery once the electrical is completed. A 10% due upon completion of the shower glass once installed is also in the contract. We would like to know since we are negotiating the initial contract payment schedule with him, because of the way this job has gone, are we still bound by it's terms? Can we enforce a 10% hold back, even though it is not in the contract, to ensure all work completed is satisfactory? We don't want any sub-contractor issuing a lien.
