a friend of mine owes...

a friend of mine owes gst from about fifteen years ago he has been garnisheed now for about ten years in the last six months or so his garnishment went up to eighty percent he originally owed $15000.00 a government rep was in town to talk with him about five years ago and said that he owed $87000.00 how can he fight this it sure doesn't seem right to me. i am not sure if he has any paperwork about the original debt but there would be records for the garnishment.

What province are you in please?

Are you saying they are taking 80% of his wages?

Are you also saying that they are charging ongoing interest?

we are in the yukon territory

2005 30%

as of April 2009 60%

his tax accountant has talked with the government and the words compound interest came up however he is not certain if or how interest is being charged.

some new information has been brought to my attention which is as follows

they have been taking $950.00 to $1100.00 every two weeks from his paychecks they have also taken every tax return since 2005

in 2003 he was advised for the first time of this tax issue the balance at that time was $101000.00 in 2006 he was told that the balance was $87000.00 he is unable to find out what the blance is at this time

In terms of the amount of garnishment in the Yukon a creditor can garnish up to 70% net wages, provided amount exempted is not less than $600/month for a single employee.

For employee supporting one to three dependants, exemption amount on monthly basis must not be less than $1,000. If employee supporting at least four dependants, minimum monthly exemption amount to increase by $150/month for fourth and each additional dependant.

In terms of the debt, the tax accountant has to figure out what is going on and make a deal with the CRA. It's very common for them to make deals in terms of penalties and interest and this debt seems to be getting out of hand.

If this accountant doesn't seem to be able to figure out what is going on and help remedy it your friend has to find some accountant that does or else see a tax lawyer at this point.

thank you for your advise my last question is if he does end up needing a tax lawyer would you be interested in representing him?

Thanks but I am in Toronto and I am retired anyway. I was not a tax lawyer either.
