It's possible to bill the estate but they may not be able to succeed except in terms of out of pocket expenses.

What would be best is for the mother to write a letter or perhaps do this as a codicil to the Will instructing that they be paid for their expenses. She should set an amount for the care giver aspect at least.

They should have a lawyer attend at the house, if possible, so that this letter or codicil is not attacked by the other siblings after her death.

Or, she can do up a Power of Attorney so they can be reimbursed for out-of-pocket expenses and then use her money, if there is any, for further expenses. It would not be prudent to pay themselves for their services as this will undoubtedly be attacked upon her death.

What they can do to find a lawyer is one of the following things.

They can contact the BC Branch of the Canadian Bar Association and use their Lawyer Referral Service. They will be given the name of a lawyer and can consult with the lawyer and the first half hour will be $25.

Or they can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.
