Iam going to small claims court in 3 days. the employer made me a sub contractor the day after my last day in a letter placed on the dash of his truck. I thought i was an employee as he even gave me holiday pay during my tour. I was leaving his employment to take a construction managment course to upgrade my white collar skills, better pay, while remainng in the trades. The lack of a record of employment (roe) meant i was unable to quallify for the benefits to take the course and he received sub contract labour for employyee wage. I require proper direction to (jurisprudence) and rulings to my case. I am a civilian and I require proper direction as i am presenting my own case. I now little, but I am aware this individual cannot have things both ways. is this clear! ?I am claiming the offset of wages paid as an employee to the wages earned as a sub contractor.

he was in full control of all, i used some of my tools for safety reason. his old were old and busted, mine are new and have proper safegards.

i worked soley for him until he went on holidays for ten days three to four months after hired. i then needed to keep working. motivated family man! did shingles for nieighbour and installed flor for other neighbour... this doesn't make me a sub to him... just have 2 jobs.

i thank you for your time . it's valuable and much appreciated . my neighbour is a social worker and is a good friend. his skills are exceptional when dealing with matters such as this. he is well versed and understands legal mch more than I. I am representing myself against council. although he is not allowed to represent me as he is not a lawyer, i feel we have excellent ground to prove my case that my former employer misrepresented his intentions as an employer. i reside in wetaskiwin alberta
