If you had to pay someone else to do some of his work then for sure you can legitimately deduct that cost from what you owe him.
It's not likely the case that a Court will say you don't have to pay him for the rest of his work as he did the work in the end. It's more likely the case that you would have to pay because you do have the value of his work and if you don't pay you would be unjustly enriched. You just wouldn't use him again or recommend him of course.
I didn't know better I would say that we have the same contractor. I live in Toronto though.
If I were you I would negotiate the contractor down a bit and pay and be done with it. He can not only sue you but can file a lien on your property as well.
